We may use third-party analytics services to collect, monitor and analyze the information collected as described above.  Additionally, we collect information from you when you register on our site, on our mobile application, place an order, subscribe to our Services or correspond with any person at XUVI with a request to be added to our Services. When registering, as appropriate, you may be asked to enter, among other things, your: name, e-mail address, mailing address, phone number, credit card information, location, connections made, login credentials (email, financial institutions), social network public profiles (such as those available via Google, Yahoo, Microsoft, Facebook, Twitter and LinkedIn), demographic information and other linked internet accounts. You may, however, visit our website or mobile application anonymously as XUVI may permit in its sole discretion.

 

How XUVI Uses Your Information

 

Information gathered when you visit our website  or mobile application or use our Services allows XUVI to personalize your experience, improve our website or mobile application or both, improve our customer service, process transactions, administer contests, promotions, surveys or other site feature, and to send periodic emails.  If provided to us, we may enter your name into one of our databases so we can contact you to obtain your input, or provide you with information about our programs and events. XUVI may share information about you with vendors and service providers who assist us with our activities and programs.  These vendors and service providers help us with functions such as fulfilling orders, managing data, and processing information. XUVI may share information and analysis with third parties, including your SPENDSCORE (defined below) it enters into agreements with in an effort to provide better information to those third parties. Spending Information and Analysis.

 

You acknowledge and agree that XUVI collects, cleanses, organizes, parses, analyzes and rates ("Spend Analysis") spend information gathered from one or all of the following sources: email receipts, receipt images, transactions from financial institutions and related information, name, email address, location, connections made, login credentials (email, financial institutions), social network public profiles (such as those available via Google, Yahoo, Microsoft, Facebook, Twitter and LinkedIn), demographic information and other linked internet accounts (collectively "Spending Information"). You expressly agree that XUVI may collect, cleanse, organize, parse, analyze, and rate your Spending Information. 

 

You acknowledge and agree that XUVI conducts Spend Analysis on Spending Information through an automated, integrated and actionable environment in an effort to maximize benefits based upon your Spending Information by combining Spending Information with information from third party marketers, vendors and suppliers and other historical or archived information.

 

You acknowledge and agree that XUVI may assign you a SPENDSCORE which is a value XUVI in its sole and absolute discretion, determines based upon the results of XUVI's Spend Analysis, Spending Information, and other information from third party marketers, vendors and suppliers as well as other historical or archived information.

 

You acknowledge and agree that any SPENDSCORE value assigned to you may change, without prior notice, from time to time based on a variety of factors, including, but not limited to: changes to Spend Analysis methods, algorithms; changes to Spending Information; and third party information. You acknowledge and agree that because SPENDSCORE is a numbering system derived using data science, it is bound to be inaccurate or otherwise uncertain.

 

Protecting Information

 

The XUVI Services are equipped with security measures to protect against the loss, misuse, and unauthorized alteration of the information under our control. However, we cannot guarantee that the information will not be lost or misused, but we will make every effort to ensure that it is secured to avoid such problems.

 

 

Reviewing and Correcting the Information

 

Our goal is to maintain only accurate data.  Accordingly, if you find errors in any of your personal information, please notify us in one of the following ways, and we will work diligently to correct it.

Location-Based Services

 

The Services may provide location-based services and, as such XUVI and our partners may collect, use, and share precise location data, including the real-time geographic location of your computer or device. Where available, location-based services may use GPS, Bluetooth, and your IP Address, along with crowd-sourced Wi-Fi hotspot and cell tower locations, and other technologies to determine your devices' approximate location. Unless you provide consent, this location data is collected anonymously in a form that does not personally identify you and is used by XUVI to provide and improve location-based products and services.

 

How We Use Cookies

 

We send "cookies" to your computer and use other technologies to enhance your online experience. A "cookie" can be either permanent (i.e., it remains on your computer until you delete it) or temporary (i.e., it lasts only until you close your browser). Edit and Delete Account Information and Preferences

You will have the opportunity to opt out of any further mailings at any time; provided, however, that we reserve the right to send you communications relating to: (i) fulfilling a transaction; (ii) service announcements, (iii) notices regarding our Terms of Use and this Privacy Policy; and (iv) administrative messages. You can delete your account by requesting an account deletion via email to support@xuvi.com. You must provide us with the email address of the registered account. After we have confirmed your request via email, we will remove access to your personal information from our user database.

 

Children's Online Privacy Protection Act Compliance

 

We are in compliance with the requirements of COPPA (Childrens Online Privacy Protection Act), we do not knowingly collect any information from anyone under 13 years of age. Our Services are all directed to people who are at least 13 years old or older.

Assumption of Risk for Sharing Information

 

Please be aware that no security measures are perfect or impenetrable and XUVI cannot control the actions of other users with whom you share your information. XUVI cannot guarantee that only authorized persons will view your information. Likewise, XUVI cannot ensure that information you share on this site will not become publicly available. XUVI is not responsible for third party circumvention of any privacy settings or security measures. You can reduce these risks by using common sense security practices such as choosing a strong password, using different passwords for different services, and using up to date antivirus software.

XUVI will not be bound by any statements made by agents or employees of XUVI which conflict with these terms, conditions and/or policies.

 

All terms, conditions and policies and any dispute arising from or relating to them will be governed and interpreted in accordance with the laws of the State of Nevada.  Venue for any legal action concerning the terms, conditions and policies shall lie exclusively in the Eighth Judicial District Court, Clark County, Nevada, and by accessing and using the XUVI Services you expressly consent to jurisdiction and venue in such court.
